It is true that the Mueller report establishes other conduct that Congress could reasonably conclude qualifies as obstruction of justice for impeachment purposes. But the above describes those broad areas in which the evidence most clearly establishes that the president acted with a corrupt purpose and in a manner that exceeded the scope of his Article II powers. The articles of impeachment drawn up against both Richard Nixon and Bill Clinton contained similar allegations. In Nixons case, the first article adopted by the House Judiciary Committee found that Nixon had engaged personally and through his close subordinates and agents, in a course of conduct or plan designed to delay, impede, and obstruct the investigation into the Watergate burglary; to cover up, conceal and protect those responsible; and to conceal the existence and scope of other unlawful covert activities. In Clintons case, both articles of impeachment adopted by the full House of Representatives touched on obstruction: One article accused Clinton of perjury, with the goal of willfully corrupt and manipulat the judicial process of the United States for his personal gain and exoneration, while the second directly concerned obstruction of the Paula Jones harassment litigation against him. The second broad area also concerns abuse of law enforcement power, but in a different sense. Whereas the first basket focuses on Trumps efforts to obstruct an existing investigation, the second involves his attempts to leverage the power of the presidency to cause investigation and prosecution of political opponents. This includes Trumps request to then Attorney General Jeff Sessions toas the Mueller report describesreverse his recusal so that Sessions could direct the Department of Justice to investigate and prosecute Hillary Clinton. There is a substantial evidentiary record concerning this type of misconduct: Mueller cites directly to testimony given by Sessions to the special counsels office, and there is a lengthy record as well of public statements by the presidentalso included in the Mueller reportexpressing dissatisfaction with the Justice Department for its failure to investigate Clinton. Trumps 2016 opponent is far from the only person he has targeted in this fashion. He has repeatedly and publicly accused FBI Director James Comey of crimes and has asked why the Justice Department has not investigated and prosecuted Comey.

Before March 2020, it is unlikely that many politicianslet alone many ordinary peoplethought it would be feasible or likely for government officials to force hundreds of millions of human beings to self isolate. But it turns out governments were indeed able to force a sizable portion of the population to abandon jobs, religious practices, extended families, and community life in the name of flattening the curve. Whether through fear manufactured by the news media or through outright threats of punishment, business owners shuttered their shops and offices, churches closed down, and schools abandoned their students. Over time, most governments lessened their restrictions, largely out of fear that tax revenues would collapse and out of fear that the public would become unwilling to obey lockdown edicts indefinitely. Those fearsnot scientific objectivityhave been guiding the gradual loosening of lockdowns and lockdown related restrictions in recent weeks. After all, in many jurisdictionsboth in the USA and in Europecases and case growth are far above what they were back in March and April when we were told that high case totals absolutely required strict lockdowns. If case numbers are higher now than during the previous peak, why no new lockdowns?Make no mistake, many politicians would to impose lockdowns again, and indefinitely. After all, the power to micromanage the behavior of every business and household in the manner of covid lockdowns is a power undreamed of by even the most despotic emperor of old. Its not a power a regime would abandon lightly. But could they get away with it?This is a question every prolockdown politician is asking. For the extent to which lockdowns have been scaled back and lessened, we cannot thank any enlightenment or change of heart on the part of politicians.
